The Supreme Court could issue at least one opinion on Monday, according to a new post on the court’s website. The announcement is sure to fuel speculation that judges are prepared to rule on whether former President Donald Trump is eligible to appear on Colorado’s presidential ballot.
The court does not reveal in advance what opinion it will issue. But the justices may want to decide the Trump issue before Colorado voters head to the polls this week for the Super Tuesday primary.
Trump’s name will appear on Colorado’s ballots, which were printed weeks ago. But without the Supreme Court’s ruling, there was no guarantee that the voters’ choice of the former president would be taken into account if a judge ruled he was unfit to serve. There is also a question of whether Trump’s name will appear on the ballot for the November general election.
The ruling could also decide other states where similar cases are pending. An Illinois judge on Wednesday removed Trump from the state’s ballot, but the decision was put on hold to give the former president time to appeal.
On February 8, the Supreme Court heard arguments challenging President Trump’s eligibility under the “Insurrectionist Clause” of the 14th Amendment to the U.S. Constitution. Six Colorado voters disqualified him for comments he made on January 6, 2021, leading to the storming of the U.S. Capitol.
The majority of conservative and liberal justices appeared concerned about the argument during arguments and appeared to support Mr. Trump’s position.
