Hunter Biden faces three charges, including making false statements on a federal firearms declaration and possessing a firearm as a prohibited person.
The indictment stems from a 2018 gun purchase. When buying a revolver in Delaware, Biden lied on federal paperwork, declaring under oath that he had not used or been dependent on illegal drugs, even though he was struggling with a crack cocaine addiction at the time of the purchase.
More details: It is a federal crime to make false statements on ATF forms and possess a firearm as a drug user. He possessed a firearm for 11 days in 2018.
If convicted on all charges, Biden could theoretically face up to 25 years in prison and fines of up to $750,000, according to court documents.
However, it is extremely rare for a defendant to receive the maximum sentence, especially in cases like this one where the crime is non-violent or a first-time offender.
The charges were filed following the failure of the agreement. Weiss announced the two-pronged agreement last June in which Biden would plead guilty to two federal tax offenses and enter into a “diversion agreement” that would see the firearms charges dismissed within two years if he passes regular drug tests and stays out of legal trouble.
But the agreement fell apart after the judge said at a July 2023 hearing that he had “concerns” that the parties appeared to be tying a plea deal on taxes to the resolution of a felony firearms charge. Attorney General Merrick Garland appointed Weiss as special counsel the following month.
