—

The Biden administration on Thursday moved a step closer to enacting rules that would require those selling firearms online or at gun shows to conduct background checks on potential customers.

The final rule strengthens requirements for obtaining a Federal Firearms License (FFL) by more specifically defining what it means to be “engaged in the business” of selling firearms, which gun control advocates say is It aims to close what it calls the gun show loophole. The Justice Department said that by making the term clearer, it aims to better regulate the market and facilitate compliance with federal background check requirements.

“Under this regulation, it does not matter whether a gun is sold over the Internet, at a gun show, or in a brick-and-mortar store. If you do, you must get a license. We will conduct a background check,” Attorney General Merrick Garland said in a statement.

Vice President Kamala Harris told reporters that the new rules were finalized just days before the 25th anniversary of the Columbine High School shooting, calling the shooting “one of the most dangerous guns purchased through a government agency.” “This was a horrific act of violence carried out using the police.” It’s a gun show loophole. ”

“Since then, too many communities, from New Paris, Ohio, to Chicago, Illinois, to Midland-Odessa, Texas, have been torn apart by violence caused by weapons purchased without background checks,” Harris said. “I believe these new rules will save countless families and communities from the horror and heartbreak of gun violence.”

The final rule will be posted in the Federal Register and become effective within 30 days. The administration first proposed the rule last August.

The bipartisan Safe Communities Act of 2022 expands the definition of being in the business of firearms trafficking, stating that “a person who spends time, attention and “Includes all individuals who expend effort.” They make profits by repeatedly buying and selling firearms. ” President Joe Biden then issued an executive order directing the Justice Department to adopt new rules to deal with those “engaged in the business” of selling firearms.

In finalizing the new regulations, the Department of Justice amended the Bureau of Alcohol, Tobacco, Firearms, and Explosives regulations to apply a new expanded definition of engaging in the business of trafficking in firearms, and to The ministry said it further clarified the activities that would likely require a license. .

The rule clarifies what it means to have a “private firearms collection” to allow “genuine enthusiasts and collectors” to add or remove guns from their collection without violating the law. , clarify what kind of FFL goes out. businesses need to handle inventory.

The new rules are estimated to affect more than 20,000 people involved in unlicensed firearm sales, according to a senior White House official.
