Jacksonville, Florida – A funeral director at the center of an investigation on charges of theft, mishandling human remains and abandoning a Northside mortuary was arrested Friday in Orange County and transported to the Duval County Jail.

Elliott Graham, 49, is wanted on charges of theft, giving the wrong ashes to a family member and abandoning a mortuary containing a body.

Investigators had been searching the grounds of the Marion Graham Mortuary on Gundy Street for several days. It’s unclear what investigators found, but there was enough evidence for the Department of Financial Services to obtain an arrest warrant.

Mr. Graham was arrested on February 2nd.

According to an arrest report obtained by News4JAX on January 30, investigators found three bodies in various stages of decomposition inside body bags at the funeral home. Investigators said the body had not been stored for long in a facility without refrigeration or air conditioning.

The bag was infested with insects, the report said.

Nairovia Darden said her family received an unexpected phone call from state investigators who told them that one of the three bodies found in the mortuary was that of her grandmother.

“While we are relieved that Elliott has been captured and charged, the damage done to our family’s sense of closure and peace cannot be repaired. My grandmother was a person worthy of dignity and respect, and she The fact that was subjected to such neglect and deception is truly heartbreaking,” Nairobia said on Thursday. “This situation has left us dealing with a whirlwind of emotions, from disbelief to anger to sadness. The violation of trust and the destruction of my last memories with my grandmother is completely unfathomable. No family should have to endure such a horrific betrayal while in mourning.”

Some rooms at the funeral home were in disarray, leading investigators to believe that Graham lived there.

Investigators repeatedly attempted to contact Mr. Graham, but the report said he continued to put off contacting them, stating that he was “unable to contact me due to personal circumstances.”

Investigators believe Graham had no intention of returning to the funeral home and “abandoned the deceased with disregard for dignity and respect,” the report said.

Several Jacksonville families spoke to News4JAX about how they trusted Graham to care for their loved ones, but experienced painful events during their mourning.

Graham faces charges including grand theft and improper preservation of a human remains. He is being held on $100,000 bail.
