Special counsel explains why Trump was indicted but Biden was not

It didn’t take long for former President Donald Trump to weigh in on the release of Special Counsel Robert K. Hur’s report that assessed President Biden’s possession of classified documents after he resigned as vice president in 2017. Ta.

You may recall that this has been a particular point of interest for President Trump over the past two years, given that the former president faces federal criminal charges related to his document retention. Mr. Trump regularly contrasts his own situation with Mr. Biden’s in his campaign speeches and social media posts, saying his rival’s dossier is greater in size and importance than his own. That was also his first reaction to Mr. Xu’s report.

“The Biden dossier case is 100 times different and more serious than mine,” the former president’s statement read in part. “I did nothing wrong and I would have cooperated more. What Biden did was an outrageous crime — he had 50 years worth of documents, 50 times more than I had. and “perfectly retained” it. Even without Mr. Xu’s report, these claims are clearly false. But Heo’s report specifically contrasted the two situations in a way that was clearly detrimental to Trump.

The comparison came as Mr. Hsu explained why he did not recommend prosecution in Mr. Biden’s case.

“While it is not our role to evaluate the criminal charges pending against Mr. Trump, it is clear that there are some important differences between Mr. Trump’s case and Mr. Biden’s,” the report said. “.” “Unlike the evidence against Mr. Biden, the allegations in the indictment against Mr. Trump, if proven, would be seriously aggravating.”

Mr. Xu uses careful language about the allegations, as he and we should too. However, the evidence supporting these claims is strong. What is known about Trump’s case points to months of efforts by the U.S. government to recover materials, as well as months of obstruction and an incomplete response from the Trump campaign. In early June 2022, his lawyer certified that all classified materials had been returned to the government. Two months later, the FBI found more than 100 people at Mar-a-Lago.

As Mr. Hur points out, it is, and always has been, that President Trump has not responded to the government’s demands any further than he had. Adding insult to injury is President Trump’s alleged attempts to share documents with people and hide evidence.

Although Mr. Xu did not and could not refute all of the claims President Trump would make in his statement, suffice it to say that Mr. Trump’s claims are false. Trump had numerous documents in his possession. Biden has far less. Although Mr. Xu did accuse Biden of intentionally retaining the documents, the available evidence makes it very clear that Trump intentionally retained his documents. (The photo of the infamous document laid out on the floor of Mar-a-Lago was recovered from the office where he entertained guests.)

Ho’s report also debunks other elements of Trump’s rhetoric regarding his handling of Biden’s documents. For example, President Trump has repeatedly mentioned that Biden kept a box in his office in Washington, D.C.’s Chinatown neighborhood, indicating that Biden was likely sharing sensitive material with Chinese officials. It is a ridiculous suggestion that this may be an indication that there is. The Hur report says Biden has not packed the boxes sent to the transition office, and most of the materials stored there will be moved to a permanent office at the Penn Biden Center offices near the White House. It proves that it has never been unpacked before. In fact, Biden did not regularly work from that office, but he “came in from time to time for meetings.”

But of course, there was no evidence whatsoever to suggest that the Chinatown office was suspicious other than being in an area with the word “China” in its name. Similarly, there was no reason to believe that Mr. Biden’s retention of documents marked as classified would be significantly comparable to Mr. Trump’s.

Although Mr. Xu’s report does provide another point to Mr. Trump’s political efforts (including his account of Mr. Biden’s memory), Mr. Biden could also face criminal charges along with Mr. Trump. It stimulates the idea. And it goes further to explain why Trump, unlike Biden, did so.

Not surprisingly, Trump is expected to ignore that part of the report.
